Nikah documents in Morocco

Marriage in Morocco is governed by the Family Code (Moudawana). The family court judge reviews the marriage file, and two adouls (notaries) then draw up the contract.

Who registers the marriage

The family section of the court of first instance authorises the marriage. Two adouls record the contract, which the judge then approves.

Typical steps

  1. 1

Assemble the marriage file and submit it to the family court for authorisation.

  2. 2

Get the medical certificate confirming fitness to marry.

  3. 3

Once authorised, have two adouls draft the contract with the agreed sadaq (mahr).

  4. 4

Have the contract approved and transcribed into the civil status records.

Common items to prepare

  • National ID card (CIN) or passport
  • Full birth certificate
  • Medical certificate for marriage
  • Administrative certificate for marriage from the local authorities
  • Passport photos
  • For a foreign spouse: certificate of no impediment, proof of Islam for a foreign husband, and certified translations

Important notes

The legal age is 18 for both spouses. Since 2004, an adult woman may conclude her own marriage, and involving her wali is her choice. Moroccans abroad can marry at a consulate or under local law and must then register the marriage in Morocco.

Family & wali considerations

Involve your wali or family representative early. Agree who attends, who speaks for the family, and how mahr and living plans will be discussed with dignity.
