In Australia, a nikah can also be a legal marriage when an imam who is an authorised marriage celebrant performs it. The couple must lodge a Notice of Intended Marriage at least one month before the ceremony.

Who registers the marriage

Authorised marriage celebrants, including registered imams, lodge the paperwork with the state or territory registry of births, deaths and marriages.

Typical steps

    Lodge the Notice of Intended Marriage with your celebrant at least one month and no more than 18 months before the wedding.

    Check that your imam is an authorised celebrant; if not, arrange a civil celebrant as well.

    Sign the required declarations and hold the ceremony with two witnesses aged 18 or over.

    The celebrant registers the marriage; then apply for the official certificate from the registry.

Important notes

The minimum age is 18, with rare court-approved exceptions. The celebrant must say certain legally required words during the ceremony, which an authorised imam can include in the nikah.
